In her ruling, Administrative Law Judge Melissa Owens Lassiter said the 104-turbine, $400m facility, which has been under construction since summer 2015, is not subject to further regulatory reviews.
A couple that lives less than one mile from one of the turbines had sought the additional reviews. They argued that Iberdrola made major design changes to the facility after the state passed a law in 2013 that imposes additional regulatory hurdles for new wind facilities – in effect, constituting a new project.
