A joint statement by the PV Business Association, AEF, the PV Industry Association, ASIF, and the Renewable Energy Producers’ Association, APPA, claims that as many as 53,000 solar producers could start separate legal proceedings for every period they are paid for. That could result in up to 630,000 cases accumulating in the Supreme Court within three years.
“Operators must appeal against all the administrative acts that result from the application of the decree, that is, all the monthly settlements of the National Energy Commission [CNE] in which the premiums are not paid, as a result of the limitation of hours that the decree establishes retroactively,” they say.
