The decree states that UTE must make payment if a generator can prove that it was able produce the electricity under those circumstances.

National grid operator (ADME) will look at each case and determine the payment amount, if applicable.

Going forward, UTE must take measures to consider such payments using power prices stipulated in contracts it has signed with power producers.

The decree comes as wind power is expected to almost triple in 2015, reaching 1.2GW
