In December, a federal judge issued a first-of-its-kind ruling requiring Invenergy to obtain a permit allowing the incidental injury or death of Indiana bats, before existing turbines at the Beech Ridge project could operate year-round and new ones could be built.
On Tuesday, US District Court Judge Roger Titus approved an agreement between Invenergy, its local affiliate, and the Animal Welfare Institute and other plaintiffs, allowing the project to proceed – with significant restrictions – while Invenergy applies for the permit.
