Last month Lady Clark of Calton said she wasnot satisfied that Scottish government officials had “complied with theirobligations under the Wild Birds Directive 2009”.

The government said then that it would consider its next move, but now says it will challenge the decision.

Developer Viking Energy, which is 50%-owned byutility SSE, has faced controversy over the plan since 2009.

Lady Clark delivered the judgement at the Courtof Session in Edinburgh following a judicial review brought by pressure groupSustainable Shetland, which wants the Viking development stopped.
