Mitsubishi antitrust claim against GE survives challenge

A federal judge denied a motion by US wind turbine giant General Electric to dismiss the antitrust lawsuit brought against it by Mitsubishi Heavy Industries last spring.

But Judge J. Leon Holmes, in the US District Court for the Western District of Arkansas, did put the case on hold pending the outcome of ongoing patent infringement suits in three separate courts.

“[I]f GE prevails in any of the infringement actions, then Mitsubishi’s claims in this action will be moot because GE will have the right to exclude Mitsubishi from the market,” Holmes writes in his opinion.

Mitsubishi, and its US subsidiary Mitsubishi Power Systems Americas, sued GE in May, alleging anticompetitive practices.
