EU challenges Ontario FIT's local content requirement at WTO

Ontario’s Feed-in tariff (FIT) – the richest renewable energy incentive on the North American continent – is being challenged by the EU at the World Trade Organization (WTO).

It is the third assault on the Canadian province’s policy on trade grounds in a year. The EU, like Japan before it, alleges that Ontario’s requirement that projects use local content to qualify for premium electricity prices under the FIT violates global trade rules.

Texas billionaire T. Boone Pickens has also brought a claim on different grounds, alleging that his Mesa Power Group was disadvantaged by “last-minute” changes to rules governing contract awards under the Green Energy and Economy Act, in violation North American Free Trade Agreement.
